General
Cornell requires all providers of catering services on campus to evidence that they have both liability insurance and worker’s compensation insurance prior to the commencement of any work or service.
The service provider shall procure and maintain for the duration of the contract the following minimum insurance:
- Workers Compensation with statutory limits in accordance with the workers’ compensation laws of New York State, and Employer’s Liability Insurance with limits of not less than $500,000 each accident for bodily injury or disease.
- General liability which shall insure against claims for bodily injury, property damage, and advertising injury in an amount not less than $1,000,000 per occurrence, and $2,000,000 aggregate.
- Liquor Liability (if applicable) in an amount not less than $1,000,000 is required.
- Automobile Liability covering owned, hired, and non-owned vehicles, and Personal Injury Protection (where applicable) with minimum limits of $1,000,000 combined single limit each accident.
- Umbrella/Excess Liability on an occurrence basis and that applies excess of the required underlying general liability, automobile liability, and employer’s liability policies in an amount not less than $2,000,000 each occurrence.
Cornell University must be added as an “additional insured,” under all applicable liability policies and coverage shall be primary and non-contributory to any insurance maintained by Cornell University. A certificate of insurance shall be furnished to the University as evidence that policies providing the required coverage, additional insured status, and limits are in full effect prior to performance of service.
Food Trucks
Food trucks may provide food at events if event sponsors adhere to the following conditions listed below:
Food trucks may not sell directly to event attendees.
Event sponsors adhere to the Cornell EH&S Food Truck Operating Procedures
There are two options for food trucks providing food during events:
- Event sponsors contract with a food truck for catering services. For example, an event sponsor agrees in a contract to pay a food truck $2,000 for a certain amount of food to be served during an event.
- Event sponsors provide, or sell, food truck tickets to event attendees. Event attendees use those tickets to obtain food.

Temporary Food Permits
Event organizers planning to serve food to the public will need to follow the Tompkins County Health Department’s Temporary Food Permit process.
University departments and University Sponsored Organizations do not need to complete the Workers Compensation Board’s Certificate of Exemption application process (CE-200) because the organizations, and their events, are supervised by University employees who are acting within the scope of their employment and employees are covered under worker’s compensation.
Independent Student Organizations need to complete the Worker’s Compensation Board’s Certificate of Exemption (CE-200) because students in these organizations are not covered under worker’s compensation. Please be aware that it may take up to four (4) weeks to obtain a Temporary Food Permit due to recent changes to the New York State Workers Compensation Board’s Certificate of Exemption (CE) application process.
Here are instructions for obtaining a CE 200 under the updated process: How to Obtain a Certificate of Exemption form 200. If you cannot obtain the CE 200 online, please complete and submit the following paper application: CE-200 Application. Submitting a paper application will likely take a lot more time to process; therefore, it is not the best option.
While completing form CE-200, you will prompted to select an “entity type.” There is no longer an option that includes student or volunteer organizations. You may select the option that best describes your organization. However, we recommend selecting “Individual (Sole Proprietor)” if you are unsure of which option to select.
If you are an international student, and do not have a Social Security Number, please contact the Workers Compensation Board for assistance.

Similar to the “entity type” issue, there is no longer a “industry classification” category for student organizations. You will need to select the option that best fits your organization.
When you reach the screen titled, “Worker’s Compensation Coverage Exemptions” you should select option 2.
When prompted to provide the Temporary Service Name and Phone number, you should enter your organization’s name and your President’s phone number.
